In Workforce America! Managing Employee Diversity as a Vital Resource, diversity is defined as: â€Å"otherness or those human qualities that are different from our own and outside the groups to which we belong, yet present in other individuals and groups. â€Å"The dimensions of diversity are further expanded but not limited to: age, ethnicity, gender, race, physical abilities/qualities, sexual orientation, education, geographical location, income, marital status, religion, work experience, military involvement. † (Loden and Rosener 1991; 18-19) Principles and Objectives To address diversity issues directly one must question: What policies, practices or current strategies within our organizational culture have differential impact o n different groups? What organizational changes should be made to meet the requirements of a modern diverse workforce and maximize the potential of all workers? The Key Principles and objectives of The Organizational Diversity Plan are as follows: * Promote awareness of workplace diversity within the organization (acceptance) * Develop and maintain a highly skilled and efficient workforce where the value and motivation of employees is present across the board * Develop a supportive environment where staff have a balance between work and their personal life * Provide a prejudice and harassment free working environment * Include diversity management principles in recruitment processes The Solution Acceptance of diversity: First and foremost, management must acknowledge that their working environment encompasses a wide variety of people. It is often difficult to see what part diversity plays in a specific area of management and how it relates to the development and success of the organization. A manager must understand that in the modern world, where migration due to education and opportunities is prevalent, diversity is an inevitable issue and must be handled in such a way that the organization can benefit and succeed. Development and maintenance of workforce: To develop an efficient team, a leader must be established within each team, group or department. The most effective team leaders build their relationships with workers through trust and loyalty as opposed to fear and power. A manager should consider the suggestions and ideas of all his employees. No idea should be considered as unworthy or idiotic. Employees should be made to feel like they belong and are part of the bigger picture. One should always seek chances to mediate and solve minor disputes before they get out of hand. This leads to greater harmony and a step towards achieving company goals. In mediating, directives should be clear and concise and must take into consideration everyone’s differences and views. The contribution of each team member should never be undervalued and the manager must remind his employees about the importance of his/her job to the success and development of the business. Employees should work on creating solutions on their own. This develops communication and builds a stronger bond. As a supervisor your initial priority in problem solving is stimulating debate. Employees are often afraid to disagree with one another and this may result in poor decisions made. Debate inspires creativity which further leads to a workforce which thrives on cohesion and efficiency. Develop a Supportive Environment: The working environment is always an important variable in having a productive staff. Diversity introduces many struggles including trying to maintain a balanced environment for employees. One must accept the fact that there is life outside of the workplace regardless of timelines and working hours. Families must be attended to, social activity to be maintained. It is up to management to forge a bridge between work and personal life in such a way that productivity is still maintained at a high level but with minimal stress. * The introduction of after work care for children of staff, will allow staff to continue to work outside of normal working hours but still be able to take care of their children. * Staff parties or outings are always a good idea to address the need for social interaction. This also gives workers a chance to understand different cultures and personalities of their colleagues. * Religious beliefs, and sexual orientations must be accepted and care taken to respect them. Prejudice and harassment free organization: The main problem realized with diversity is discrimination which comes in many forms. There should be a zero-tolerance policy with relation to prejudice or harassment of any kind. Regardless of race or culture or gender, each employee was hired for a particular set of skills or envisioned potential they could offer to the organization and they should be allowed to display and hone them. Discrimination breeds separation and breakdowns in communication which impacts very negatively on the productivity and advancement of any business. Where discrimination is identified as an issue, all efforts should be made to address the situation(s) as quickly as possible. Discipline must be swift and – in extreme cases – harsh in order to set the standard for further issues. Diversity management principles in recruitment: During recruitment and interviewing processes, management must bear in mind that everyone must have the same access to opportunities and ensure that a nondiscriminatory standard is used for the selection process. This can be aided by: Forming diverse selection committees to ensure bias free selection * Salary and incentives should be offered equally regardless of ethnic origin or sexual orientation * Make sure there is equal opportunity for both men and women Conclusion Management of diversity is one of the key goals of the modern organization. It is extremely important to comprehend how the dynamics of diversity affect performance, productivity, motivation and success within the business and le arn how to merge them. Internet Protocol Security (IPsec) - Research Paper Example In order to ensure security of information over the Internet various security technologies have been proposed that usually work on the higher layers of the OSI model and provide security in terms of authentication, confidentiality, integrity and availability. IPSec is one such security technology that operates on the IP layer and provides confidentiality, integrity and authentication. As it operates at the IP layer, its implementation provides security in the higher layers as well. And its implementation is such that the existing setup of Internet does not have to be changed in order to implement it. This report presents an overview of the IPSec technology. It discusses the general architecture of the technology, briefly covering its technical details and its operation modes. Furthermore the report discusses how IPSec can be integrated into the existing Internet setup. 1. Introduction The security of information is defined by four attributes; confidentiality, integrity, privacy and a vailability (Adeyinka, 2008). In the past, when computers were not that common a commodity let alone the Internet, virtual private networks were formed through installation of dedicated leased lines between the hosts e.g. networking of remote offices (Liska, 2003). Figure 1 Dedicated Leased Lines VPN Since these lease lines were private the information sent or retrieved remained within the related parties and so the communication was fast and secure. Thus private networks were formed. But the setup was costly and very few companies could afford it. Later on, in order to accommodate the mobile users, the companies installed dedicated remote dial-in servers (Remote Access Servers) that had modem(s) each connected to a separate dedicated phone line (Liska, 2003). Figure 2 Dial-up VPN Although the networking was achieved, yet the effort was not that useful as the speed of these networks was very slow. With the advent of the Internet and its global web servers that provided larger and ea sier access worldwide, the use of leased lines became an expensive burden and remained limited to very few resourceful companies. In view to the easy access to worldwide communication granted by the Internet, the element of security somewhat lost its significance and every other school, office, company and business sought out to be connected through the Internet. The instances of some serious cyber crimes (â€Å"Cyber Crime Stories†) led to the realization that the Internet is not at all secure. Being a public medium, the information sent across the Internet in the form of data packets passes through various networks until they reach their intended destination. Since the Internet protocol (IP) offers no built-in security, this plain text data in the IP datagram cannot be prevented from unauthorized access from the public network. Any third party can easily inspect, even modify or generate false data and compromise system security. The Pros and Cons of the Libel Defences of Justification and Fair Comment Essay Libel law in England is incredibly tough, so much so, that if found to be liable of a defamatory statement, ‘a statement which lowers someone in the eyes of reasonable people ’ [Quinn 2009: 210] the consequences can be very costly to both the journalist themselves and their newspapers and therefore it is very important for the defences of defamation to be used to full effect an example of this is libel tourism and the case of involving Roman Polanski 2005.The magazine had said that the event had take place before the claimant’s wife’s funeral, but it had in fact taken lace after the funeral, which Mr Polanski completely denied. As it could not be proved, the claimant won ? 50,000 in damages. There are seven different defences for the act of defamation, of which two of these, Justification and Fair comment, we will analyse the advantages and disadvantages below. For the defence of justification to apply, the defendant must prove that what they have written and published is substantially true. If this can be proved by the defendant then they will have a complete defence against the claims of defamation. The defence of justification may only be used where the defendant has published a statement of fact. One of the main disadvantages of the defence of justification is that the burden of proof relies upon the defendant, which means that they must prove what they have published to be true. Furthermore, the claimant does not have to prove that what you have written is false or that any fact found to be false was damaging to their reputation. Another disadvantage of this defence is that ‘A defendant cannot rely on the defence of justification in relation to the publication of the details of spent convictions, as efined by the Rehabilitation of Offenders Act 1974’ [1] This Act has been brought in to help with rehabilitation of offenders and prevents journalists from acting in a malicious manner when relating to cases of this nature. An advantage of the defence however is that the journalist does not have to prove that what they have published was in the public’s best interests and furthermore they do not have to prove that they acted in a malicious manner. A further disadvantage to the defendant is that any rumour they chose to publish must be backed up by evidence of the accusation made within the rumour. This means that the defendant cannot base their evidence alone on a previous rumour. However an advantage to the defendant comes by way of a case where the claimant alleges that more than one fact within a publication is untrue. In such a case, the defendant need not prove that all claims within the publication to be true and must only prove that ‘the ‘sting’ of a libel’ [Quinn 2009: 212] to be true. This suggests that only the most important allegations, which are damaging to the claimants reputation, need to be determined to be true. This can be seen in the case of Turcu News Group Newspapers, where the defendant was sued after publishing a number of defamatory statements including some which were found to be untrue. However the statement made that the claimant was a ‘petty criminal with a long list of convictions’ and that ‘he was willing to take part in criminal activities’ were true, and the defence of justification stood on the grounds that the sting of the statement remained true. A further advantage to the defendant is that ‘A claim of justification need not only be based upon facts as were known at the time of publication; if other facts come to ight during the period between a claim and the case coming to court, they can be used to back up the defence. ’ [Quinn 2009: 214]. This appeared in a case in which involved Kate Moss and Channel 5, where a documentary was claiming that Moss had taken cocaine on a photo shoot in Barcelona and fallen into a coma. Kate Moss sued channel 5, but during proceedings she was captured in pictures taking cocaine. Due to such evidence, Moss chose to drop her claim. A final disadvantage to any defendant involves the likely case where, the defendant uses the defence of justification and is unsuccessful. In such a case ‘an unsuccessful defence of justification is likely to increase the level of any damages awarded. ’ [2] In the case of Archer v News of the World (1987) the newspaper was successfully sued by archer after claims were made by the paper which they could not prove, this in turn resulted in a payout to Mr Archer of ? 500,000 damages. It was later discovered that the claims made about Archer were true and he was consequently imprisoned for perjury. This case is a clear example of a situation where the jury are start struck and are therefore biased in favour of the claimant. The defence of fair comment applies to cases where the defendant has been accused of publishing a defamatory comment or opinion. For the defence to apply, the defendant must prove that, the words complained of were a comment or opinion, not a statement of fact, the words were about a matter of public interest, any facts which the comment was based on are true, or subject to privilege and that the comment was made without malice and so was an honest belief of the defendant. The first and main advantage of Fair comment applies to a case where the defendant can prove that the statement made, was one of personal opinion and one hich they fully believe ‘to have been made honestly’ [Quinn 2009: 216]. This was shown in the case of Branson v Bower (No. 1) where the claimant tried to sue on the grounds that the comment made could be taken as statement of fact. The court of appeal disagreed, stating that it was clear that the statement published by the defendant was an opinion. Another advantage of this defence is that much like that of justification, the defendant must not prove that each of the facts in the publication to be true, as long as they can prove that those facts commented on were true. In the case of Galloway v Telegraph Group Ltd (2006) the defendants claimed that they had based opinions upon facts they believed to be true about the claimant. The defendants pleaded fair comment but this was refused by the court stating that ‘the stories were allegations of fact’ [Quinn 2009: 217]. Again, a disadvantage of this defence, much like that of justification, is that it is the defendant’s responsibility to prove that ‘the underlying facts are true. If he or she is unable to do so, then the defence will fail. ’ [3] This appeared in a case involving Gordon Ramsey, where the defendant during a review complained that some scenes within the show were staged. The defendant could not back up these claims and consequently had to pay ? 75,000 in damages. Another advantage to the defence of fair comment is that any person may be entitled to comment, when the subject in matter is of interest to the public, due to either interest or concern at a matter which could affect them or another. A disadvantage to the defence of fair comment is where the claimant can show that what has been published against them has been done so with malicious intent. In such cases the defendant will not be able to use the defence of fair comment. This was shown in the case of David Soul v Matthew Wright, where the defendant criticized the claimants acting without having been to see the show. As he had not been to see Mr Soul’s play he had no facts to base his criticism on and consequently had to pay damages. A final advantage of this defence is the definition of fair comment. It is stated that ‘even very rude and critical reviews can be covered by the defence of fair comment, so long as the facts on which they are based are true. [Quinn 2009: 220] this basically means that it must only be proved that the facts upon which the opinion is based upon must be true for the defence to be used. This was seen in the case of Tse Wai Chun Paul v Albert Chang, the courts stated that ‘even where a writer is motivated by ‘spite, animosity, intent to injure, intent to arouse controversy or other motivation’ they can be covered by fair comment’. [Quinn 2009: 219] In conclusion, I’d say that in both of the defences the claimant has the advantage. The first of these reasons is due to the burden of proof, which the defendant holds, nd in turn puts the claimant in a no lose situation. The second of these reasons is the possibility for further damage to the defendant in a case where they cannot prove their innocence. This leaves the defendant in a position where they must risk further detriment to prove their case. Also, and finally, where a defence fails, this can prevent the public from knowing information which may be within their [the public’s] best interests, which could subsequently harm the good of the public. Due to the many implications and faults of the law, it is soon to be changed.

This report helps us to assess the current strategy of our enterprise using internal and external analysis. External analysis of spark furniture will identify major factors affecting the industry in which it is operating and to relate its opportunities and capabilities. PESTEL, Michael Porters Five Forces framework and SWOT helps to examine the strategy of spark furniture. Company overview Spark furniture emerged by taking over a small enterprise dealing with furniture groups operating from couple of years. It went with a unique strategy of cost leadership. Its products are Bed, Sofa, Dining table, and Coffee table. It has the third highest market share in overall market segment. The company is well s and known for its lower unit cost and offers lower price than competitors. Strategy Strategic management is defined as The art and science of formulating, Implementing, and Evaluating cross functional decisions that enable an organization to achieve objectives. (Fred, 1999) The strategic position is concerned with the impact on strategy of the external environment, an organizations strategic capability (resources and competences) and the expectations and influence of stakeholders (Johnson et al., 2008). Strategy is the pattern or plan that integrates an Organizations major goals, Policies, and action sequence into cohesive whole (Henry et al., 2003). Goals: States what is to be achieved and when results are to be accomplished, But they do not state how the result are to be achieved. Major goals those that effect the entitys overall direction and viability are called strategic goals (Henry et al., 2003). Policies: policies are rules that express the limit within which organization action should occur. These rules always take the form of contingent decisions for resolving conflicts among specific objective. (Henry et al., 2003) The strong strategic position is an indicator of high profitability and growth. The strategic position of Spark Furniture can be understood by carrying out different analysis on its external and internal environmental factors, and understanding its capabilities. External environmental analysis The different layers of environment that affect the market trends can be classified as macro-environment, Industry, competitors and markets. The analysis of these layers will give a better understanding of factors affecting the performance of Spark Furniture. (Refer Appendix A) PESTEL In analyzing the macro-environment, it is important to identify the factors that might affect a number of essential variables that are likely to influence the organizations supply and demand levels and its costs. (Henry et al., 2003) The Pestle Analysis is used to analyze the factors prevailing in macro-environment which may or may not influence the business, but knowing them and understanding them will help in overcoming uncertainty. (Refer Appendix B) Political Factors: Government regulations like taxation, labor policy, and excise duties issues may be a threat, as these policies will change with the change in government. Recently increase in VAT by 20% led our sales to decrease we are trying to cut down prices and provide customers with their requirements with a reasonable and effective fair price keeping in mind both companies and customer interest. This would help Spark furniture to increase its sale. Recession also affected the companys market share. It reduced peoples earning and spending capacity. Environmental Factors: Furniture industry has a number of environmental impacts that are caused by humans. The emergence of environmental concern as one of the critical factors in strategic business planning indicates the growth of environmental movement in the market place (Menon et al., 1999). Spark furniture focuses on furniture reuse, Environmental disposal green transport and recycling the products which cannot be repaired. This becomes advantage to some extent as it is able to reach the people easily with eco-friendly sense. Social Factors: These refer to what is taking place socially in the markets in which it operate or expect to operate like cultural norms, Population growth rate, Age distribution, Global warming(Due to cutting down of trees). The changes in life style of the people and attitudes to work and leisure also persuade market share. Sometimes strikes affect the market share. In Spark furniture there was a transport strike as the labour union and the employers have not reached a new collective labour agreement. For this reason during 6th period only 70% of goods are delivered and during 7th period no goods are delivered because of which company has to suffer a share loss of -0.17%.(Refer Appendix C) Technical Factors: Change in trend throws a challenge in providing customers with latest trend in the market. But on the other hand this gives an opportunity to be a leader in the market if the trend is grabbed by using latest technology and brought it to customers. These factors can affect the cost, Quality and may lead to innovation. For example, development of online shopping is well established in the market and upgrading the manufacturing process will yield to high quality products. Economic Factors: Economic factors affect industries are Access to credit, Demand for goods, and Technological advancement. The main economic threat would be existing competitors in the market. Company had a loan of  £150,000.00. Interest rate may go up due to inflation in the market this could affect the supply chain due to shift in the cash flows. Spark furniture has successfully sold its entire inventory from last 6 periods at the cheapest price possible apart from its competitors. Legal factors: Spark furniture follows the rules and maintains the specific standards set by the law, so that there is no difference of interest. These factors can affect how a company operates, its costs, and the demand for its products. Also, as it is taken over an existing business, all the legal documentation must be verified thoroughly. Limitations of Pestle Analysis: As the external environment is changing constantly, PESTLE analysis should be done on the current market situations (Cambell et al., 2002). It is also essential to analyze the level to which PESTEL is applied. When considering companies such as Apple, Samsung, PepsiCo, Volvo and Disney it is important to consider that they have many different parts to their overall business they include many different divisions and in some cases many different brands. Porters five forces model Porters five forces is a framework for the industry analysis and business strategy development developed by Michael E. Porter in 1979. It draws upon economics of industries to derive five forces that determine the competitive intensity and therefore attractiveness of a market. (Refer Appendix D) SWOT analysis An analysis of strengths weakness and opportunities threats has been drawn for Spark Furniture. (Refer Appendix E) SWOT analysis of Spark indicates where the company is good at and the areas of improvement. It helps as a planning tool to evaluate its strategic position and to relate it to its competitors (Basu, 2009). Stakeholder Mapping Stakeholder Map shows relationship of stakeholder individuals and groups to one another and finds out the role which each entity is playing. It also shows how an organisational environment must be navigated for successful implementation of change (Berkhout, 2002). Stakeholder Map of Spark Furniture is shown in Appendix F. Strategic group analysis Strategic groups are organisations within an industry with similar strategic characteristics, following similar strategies or competing on similar bases (Johnson et al., 2009). Strategic group analysis can be useful for the following: Understanding competition Deciding a Strategy In the Furniture sales world there exist many companies that try to be the market leaders by maximising their profits and expanding their market share. Spark Furniture is accompanied by other competitors like Leaf furnishing and Green furnishing. The identical strategies like cost leadership, differentiation, focus or stuck in the middle could be followed by these companies because most of the furniture companies deal in common products like the Bed, Sofa, Dining table and Coffee table. Entry of new competitors in the market increases the competition. Availability of more attractive and cheaper versions of products and services will always makes Spark Furniture to upgrade the technology which could increase the research cost. Down fall in the economy could result in the decrease of demand for furniture goods which could affect the overall demand and market share. Strategic capabilities According to Johnson Scholes (2009) strategic capability can be defined as the resources and competences of an organization needed for it to survive and prosper. These capabilities differ from organisation to organisation. Examples of capabilities are logistics, frugal systems etc. Having these capabilities differentiates them from others in achieving a better market share. Strategic capabilities are combination of Threshold resources, threshold competences, unique resources and core competences. Threshold resources: Threshold resources of Spark Furniture are its ability to provide a wide range of choices and offers to consumers at a low price than its competitors backed up by its product quality. Threshold competences: Threshold competences are the processes to be followed, to meet the requirements of customers. For Spark Furniture their aim is to provide products at an low price while keeping the standard quality. Unique resources: The unique resources are unique techniques that help in knowing the drivers of competitive advantage. The unique prices and exhibition of products by Spark Furniture help them to reach a wide range of customers like people who could not spare more money for shopping. Core competence: Core competence for Spark Furniture is its growth strategy of Cost Leadership which helps in offering unique attributes valued by customers for a low price, and perceived to be better than that of competitors. This allows the enterprise to achieve leadership in market and long term sustainability. The following analysis shows how the decisions undertaken affect the market share of Spark Furniture and its impact on its income and growth. (Refer appendix G) Cost Leadership: The strategy of Cost Leadership helps the way Spark Furniture operate as they tend to target to provide their customers with a good quality products at a very low price than its competitors which helps them to perceive better than their competitors. Market Penetration: This strategy of growth has been adopted by the company to introduce existing products in existing markets in an attempt to leverage the companys brand name. This could enable the company to create a broader customer base. The impact of the above decisions can be known by looking at the market share they are able to take part of the competitors market share and by finding new customers or by getting current customers to use more products. It is considered a low risk method to grow business. Strategic clock The model of strategic clock has been adapted from Cliff Bowman. Strategic clock shows the different positions in a given market where customers have various needs in terms of price (Johnson et al., 2009). By using this model we can study the competitive advantage of Spark Furniture. Bowmans strategy helps us to find out the companys competitive status by using some strategic options. These options are the No Frills, Low Price, Hybrid, Focus and differentiation. Of the various strategic options Spark Furniture had opted for Low Price that is where the company seeks to achieve a lower price than its competitors at the same time providing similar benefits and quality as their competitors. (Refer Appendix H) The reason for the company to adapt a strategy like Low Price is that it could target the people that are most interested in Low price products. As result of the above strategy the concept of Cost Leadership will also be achieved so that control over the price elasticity of the goods sold can be achieved. Competitive advantage The main competition for Spark Furniture is from Leaf Furnishing and Green Furnishing for the leadership in market share and growth. This is making the market segment competition more severe. As a result of the Cost Leadership strategy adopted by Spark Furniture, they are enjoying a healthy market share which is reflected in the rising growth of their market share considerably and as a result the inventory turnover is good and which in turn increased their income. (Refer Appendix I) Sustainability of spark furniture Sustainability of Spark furniture can be explained by analysing the key areas in its organisational growth. The main strategic decision of Cost Leadership helps the company to retain their own customer base which in turn helps in achieving a steady share in market for a long time. Its policy is to provide good quality goods at an affordable price due to its innovative price strategy. This helps the company to maintain its aim of providing products at lower prices than its competitors and thus increasing its brand value. The main costs that could occur for Spark could be, in its education level in order to build up its innovation areas to provide more quality products and still been able to maintain low price. It also needs to spend a bit on Human Resource areas in order to keeps its staff happy and retain their loyalty for a better future as the loyalty of employees is not looking great at the moment which could affect the quality.(Refer Appendix G) From customers perspective Spark Furniture could sustain in the future as long as it can give customers the quality products at a lower prices than its competitors and by doing so it can maintain its brand value and image which could help the company to grow more heights. The other factors that could threaten Spark Furniture sustainability like their slow growth in innovations which could bring down quality of products and thus affecting its market share and need to improve its HR area in order to be more affective in their customer service. Though the company is having a consistent income there is a need to increase its income growth by increasing the sales income of the income which at the moment is bit low. (Refer Appendix G) Conclusion By examining the strategies implemented by spark furniture it seems like they adopted a strategy which suits them. However, they need to be aware of the internal and external environment which changes continuously and the company needs to be ready to adopt a different kind of strategy that could be appropriate for the situation for retaining and increasing their market share. The Landscape of History Essay -- Book Review, John Lewis Gaddis

In The Landscape of History, John Lewis Gaddis makes a cohesive argument concerning about the debate over the objectivity of truth by stating â€Å"objectivity as a consequence is hardly possible, and that there is, therefore, no such thing as truth (Gaddis 29). The question for objective history has long been debated by numerous historians, and the differing viewpoints of history have led to a transition in our ways of thinking in the modern world. Ultimately, the question that this paper focuses on is: to what extent is history objective? Along with this, the relation to historical consciousness and the challenges of living in modernity will also be assessed. This paper will analyze the texts of John Lewis Gaddis, Nietzsche and the Birth of Tragedy, Modernity and Historical Vision, Living in Modernity, and Hermeneutics. Finally, the paper will argue that history is not largely objective, and is fundamentally shaped through the historian’s subjectivity.
